Following appeals heard by way of the hearing procedure, the Practice successfully obtained both a full award of costs and a partial award of costs against Tendring District Council relating to its unreasonable behaviour relating to a full planning application and an associated application seeking express advertisement consent.  The Inspector agreed with the Practice that the Council had put the appellant to unnecessary and wasted expense in failing to advise the Practice that it would not be presenting any case in support of its refusal of the advertisement application, and the Inspector also concurred that the Council’s failure to present any expert evidence to justify its traffic and highways reason for refusal of the planning application had put the appellant to unnecessary and wasted expense in addressing an unsubstantiated reason for refusal.
